Did you sell it with a clean title or a salvage certificate? Your insurance was required by California law to contact you within 10 days of the vehicle being declared a total loss to begin the process of getting a salvage certificate, so if they didn't do that and you unknowingly sold it with a clean title you may be okay there.
Based on what I've read on the California DMV site, it was/is still your responsibility to get the car smogged regardless of whether the buyer agreed to do this or not.
As far as the head gasket, don't give them a penny.
