Based on what I've read on the California DMV site, it was/is still your responsibility to get the car smogged regardless of whether the buyer agreed to do this or not.
As far as the head gasket, don't give them a penny.

I sold it to them with the clean title, I personally asked someone at the DMV and they told me that I can sell the vehicle with the clean title, I just have to inform the buyer of the situation, which I did. So I'm fine there. It doesn't matter, I don't think they are going to file, they haven't responded for 2 days and I haven't heard anything from any other source. They were either trying to scam me, or they realized they can't get more than 250 so they gave up.
