OPINION
ORS 806.020 exempts from financial responsibility laws "any motor vehicle not operated on any highway or premises open to the public in this state". Petitioner provided credible evidence establishing that his vehicle, which was selected for random verification, has not been operated upon public highways or premises open to the public since the fall of 2016.Because Petitioner's vehicle has not been operated upon premises open to the public since well before the verification date, Petitioner is exempted from maintaining liability insurance on the subject vehicle. Therefore, the future financial responsibility filing requirement must be withdrawn.
ORDER
The Department shall not suspend Petitioner's driving privileges for failing to make future responsibility filings in this matter.
...so, 10 months later, 7 DMV notices, 2 phone calls to DMV helpline, 1 call from a DMV manager, 1 form testifying that the vehicle was not in my possession or being driven, and 1 hearing by judge, this whole thing is dismissed. The whole matter could have been summed up in this conversation;
Them "Did you have insurance on the vehicle?"
Me "No."
Them "Why not"
Me "I wasn't driving it, and it was parked in my parent's field."
Them "Oh, well never mind."
