Go with that one as it'll have less emissions.
eg: the 2004 one is at 4.2L\100k combined and 113g\km of CO2.
The 2009 one is at 4.1\100k combined and 109g\km CO2

Does your 1ND-TV have a CAT? I was talking with a guy over the weekend and he said most of the Japanese cars are going with a NOx trapping CAT instead of Mercedes urea injection. Know anything about this or any other emissions stuff that might not come with just the engine swap?

Mine doesn't have any fancy urea injection, nothing of it mentioned in the manual. In any case, if wikipedia is right then i do about 84g\km of CO2:
