I was running some math and .1 gal is a severe penalty for cars that get higher gas mileage. Taken to extremes I could bring a semi that gets 4 mpg and come in 15 minutes late and it knocks down my percentage above EPA by only a bit.
With a little more calculation I figured out that taking off the % over directly affects both equally. Every minute deducting 2% off your epa overage works out better. Maybe 3% to shun over-timing it for even more gain. 2% means you need 3-4 mpg more to cancel 5 minute penalty. Even if the percentage penalty is set higher, I think it makes way more sense than gallon based penalties.
