Just peeking at the road via Google Maps, the first section I looked at east of Victoria didn't have much in the way of shoulders at all - about a two-foot wide strip of asphalt beyond the fog line.
It doesn't matter who drives on that road. According to the complaint, it would appear that Constans was attempting to drive on the road, but failing.
