From the time that a patent application is filed, until a patent is issued or the application is finally rejected, the product may be marked "Patent Pending". This is not legally required, but patent attorneys strongly recommend doing it.
After a patent is granted, the product must be marked with the patent number.
Claiming "Patents Pending" if there are no active patent applications is fraudulent.
For more information, the best source is the U.S. Patent Office at
United States Patent and Trademark Office. Patents, and patent applications, can be searched from the official USPTO web site at patft.uspto.gov or from Google at
Google.
The home page of
Nano-Technology Breakthrough lists Chris Arnold as inventor, and also states "patents pending". I was unable to find any patent applications about nano diamonds with Chris Arnold as an inventor.
