As far as a helmet goes, there are 19 states that even require a helmet while on a regular motorcycle, my state, Wisconsin doesn't require a helmet but only eye protection.
If you need a motorcycle license to drive the Elio, then you can take the test in it, too. If you have to wear a helmet, then get a half helmet or a 3/4'ers. Hopefully, they can get the laws adjusted, since it is enclosed, has seatbelts and air bags.

Ah, I see the pictures, now. They have revised the front suspension and the headlights and the fenders. We should see the P5 fairly soon, with their own engine.
