This (past) motorcyclist once had to swerve onto the grass when an oncoming Toyota Pathloser or some other 4x4 like that cut the corner on my lane. I saw it coming straight on and knew I would die if I did not do something drastically.
I threw the bike on the grass expecting to drop it there, but I somehow managed to keep it upright. Wet the leather though, and it took me some time to regain the nerves to get rolling again.
Throw the book at them... well they were holding the book. And merrily chatting to each other. My sister is an officer and I hold the police in high esteem, but this was not a good day. Glad I did not ruin theirs by reddening their windscreen.
All I want to say is that to err is human, and the vast majority of people involved in incidents like these feel bad about it and would have acted differently if they realized what was about to happen.
It is better to be extra cautious than revengeful.
