White collar crime is harder to prove than straight thief. You have to prove intent not just possession.
To successfully prosecute Paul Elio for fraud you would have to prove that he never intended to deliver customer vehicles when he took the deposits. His basic defense would be incompetence.
It would be easy if Elio took the money and ran but he didn't do that. Instead he took the money and pissed it away trying to keep his under capitalized company afloat.
