I still wear my Elio tee shirts every chance I get (since they cost me roughly 50 bucks apiece due to my 100 buck deposit) but I get the feeling that they're as close to an Elio as I'll ever get.

On a positive note they're really high quality tee shirts!

They could also be working with a motorcycle or UTV manufacturer. The Elio is legally a motorcycle not a car.

Elo motors was almost a conspiracy theory.
Buying a drive train from some one who does large motor cycle drive trains means it could actually happen.

White collar crime is harder to prove than straight thief. You have to prove intent not just possession.

To successfully prosecute Paul Elio for fraud you would have to prove that he never intended to deliver customer vehicles when he took the deposits. His basic defense would be incompetence.

It would be easy if Elio took the money and ran but he didn't do that. Instead he took the money and pissed it away trying to keep his under capitalized company afloat.
