That's one of my reasons for heavily penalizing drunk bicyclists: even if you're in the right when you kill or maim a drunk on a bike who falls into your path of travel, there will be hell to pay.

First, you need to definitively prove it was not your fault, which may very well take an expensive lawyer to do. This is especially true if the guy's drunk buddy testifies he saw the whole thing and it's your fault, or whatever might be the case.

And if you convince the DA that it wasn't your fault, the survivor or the surviving family still will likely take you to civil court for the damages that you personally inflicted upon the poor victim with your big car. If you win or lose the case and even if your insurance pays, we all pay through higher premiums. If your insurance doesn't pay, or pay enough, you will pay, to the detriment of you and your family.

I say, keep the drunk bicyclists off the road, even if they don't like to be cited for DWI.
