It is used in the down position. The emergency brake still functions normally.
What's nice about the bike brake design is that when you let go it returns to idle just as fast as letting up on the pedal. In addition, the bike brake also has a return spring built in. I don't see any safety issues in this design.

I would think that specialty controls like that would be very expensive.
The bike brake style of design could be built for free...
