It is used in the down position. The emergency brake still functions normally.
What's nice about the bike brake design is that when you let go it returns to idle just as fast as letting up on the pedal. In addition, the bike brake also has a return spring built in. I don't see any safety issues in this design.

The hand throttle on the Aerocivic can either be locked to hold a throttle setting to act as a "driving with load" cruise control or it can be used unlocked as an alternative throttle control when my foot gets tired on a long trip. basjoos -Thanks for the description of how your hand throttle works.

*** UPDATE ***

I went back and corrected the mushy anchor point with this.



The new anchor gives it solid feel and allows for additional adjustment.

I was thinking of this or a push mower hand throttle, until I saw Donkey CRX' hand throttle. My grandpa had used a hand throttle from an airplane for this and a cruise control in his 79 diesel Rabbit. It had friction built in, and you could pull it for fast or large throttle changes, or spin it for slow or small adjustments...something like this:
