I'm coming down on the side of evolution on this. Speeding - indeed, a history of it - inattention, misplaced blind trust despite repeated warnings. He was looking for trouble and found it. The kicker is that Tesla gets a big nasty flaming bag of poo on its porch as a result, which isn't entirely warranted.
