Tesla has said the braking issue is software-related, and they'll be issuing an over the air firmware update soon. (I've seen mention of both ABS calibration and electric vacuum pump control.)

In a surprising display of humility, apparently Musk even called Consumer Reports to talk about their review and thank them (!) for bringing the issue to light:
