Nikola Corporation has a total of six patents. They are all design patents, which are different from utility patents. Design patents consist only of one or more drawings, and they cover only things that look like those drawings.
The United States patent system, like the rest of the world, is on "first to file". Whoever files the first patent application for an invention gets the patent. If Shepherd777 publicly disclosed anything in a Nikola patent before the Nikola patent filing date, then that Nikola patent is not valid.
You can read the Nikola patents by going to patft.uspto.gov, click on Advanced Search under patents, then use search criteria an/nikola.

It's dead!
Well, not yet. But after the allegations of the Hindenburg report, the investigations by the SEC and DOJ rolling in and CEO Trevor Milton sudden resignation the writing is on the wall.
The Nikola One never was alive. Though it was filmed while driving through a desert-like area, Hindenburg Research revealed it had actually just been rolling down a slope after getting towed there. And that was just one of over 50 acts of deceit.
With so much gone wrong it gets really hard to believe the company is worth its market cap, or anything at all for that matter.
But now Stephen Girsky, a former GM vice president, takes over control.
To GM Nikola can be useful, if only because it can sell GM-built EV trucks with a Nikola badge and be eligible for the $7,500 tax rebate that GM already used up themselves with the Volt and Bolt.
So Nikola is here to stay.
That is, Nikola badges to be affixed to GM-built trucks will stay.
And that truck is named the Badger. Go figure...
The Badger in better days as Nikola vehemently tests this stunning computer rendering in harsh conditions.

It is a mild grade but a very long stretch. A semi will pick up decent speed, even if it only runs on fairy dust.
If you thought Nikola's founder Trevor Milton was just a victim of circumstances, take a dive down the Badger's hole:

Why buy a new brand name so you can get EV credits vs just make up a new one? Just keep making new GM lines or even bring back old ones like Oldsmobile and Pontiac. That makes me wonder. Will they get new credits for the GMC vs Chevrolet? Would Ram get separate credits from Chrysler and Dodge? If each sub-brand gets their own credits then Tesla needs to start making a different brand for the Cybertruck. Like say the Alset Cybertruck.
Edit: I guess it goes by automaker, but that doesn't totally make sense as VW is listed separately from Audi and Porsche.

I can only assume it depends on the particulars of how these brands are owned, and that if it was easy to spin off a new brand to get credits, it would be commonplace.
This underlines the main failure of the credit, that it should have been a single pot of money available for the first x number of vehicles sold regardless of brand.
Of course, there should never have been a tax credit because this is an expensive and foolish way to reduce fossil fuel consumption.
