They let it sit overnight and still encountered poor brake performance the next day. Even used 2 different cars to test.

Yeah, CR said: the first stop (of all braking tests) was the shortest. It was never repeated, even the next day when they repeated the tests.
They said Car & Driver also saw "bizarre" variability in stopping distances. (That's not a word I'd expect them to use if they're just talking about brake fade, something they have plenty of experience with.)

I am guessing it has to do with integrating the regenerative braking with the friction brakes.
I may be wrong, but I think earlier Tesla's did not have regen on the brake pedal?

ABS fixed remotely, CR now "recommends" Model 3

So the ABS software update made the touchscreen hard to use, or did CR's testers just phone it in?

The Model 3 is not brake by wire. Like almost every other car in the world, it has computer controlled ABS; but the braking is purely mechanical / hydraulic. It doesn't even have what virtually all other EV's have, which is regenerative braking integrated onto the braking system.
