When I sell my Dodge, I'll put a sticker on it saying it gets 150mpg. (if it's going down a 150 mile hill with a tail wind, AC off, windows rolled up, and someone pushing)
What? It could get that much.

Honda will appeal the verdict to superior court and at that point they can use lawyers. This is about to get extremely expensive and time consuming for the plaintiff. Honda has nothing to lose and everything to gain by throwing all their resources at the appeal.

Wow, I'm surprised.
So, I wonder who gets sued next. Kia/Hyundai's owners have been up in arms about their cars not meeting EPA ratings too. SUE SUE SUE!

Honda Hybrid poor mileage?
Honda was successfully sued for crappy mileage. The owners probably sit in their cars smoking at lunch

It makes sense to me. The meat of this claim was about the degraded performance now that the car has aged. Honda denied any change in performance, but then put out a software update that reduced the car's demand on the pack. As a result, it runs the gas side harder and returns lower mileage. The car in its current state cannot match the numbers it got when new.
Analogy: Ford sells a Mustang with a transmission that can't handle the V8 torque. Ford issues a recall and swaps the engine for a V6 instead. Owners sue because the advertised V8 performance is no longer available.
