I got my settlement notice a few days ago too. Mine being an '03 I can claim the $100 "dissatisfaction" payout but not the recalibration payout for the 2nd gen HCHs. I find it odd that this only applies to the 2nd gens since I have heard complaints about it on 1st gens too. That recall is still open on my car and it will stay that way as long as I own it.
What I'm really interested in is the extended IMA warranty business. It states that if you paid to have your pack replaced during what would have been the settlement mandated extended warranty period (which would have been up to 9 years or 92,000 miles with the extension) you are entitled to be reimbursed. Now, I never had my pack replaced, but it started throwing codes well within that time frame. I wonder if that entitles me to anything. As of now I am driving it ICE only as it will throw P1449 in short order if I enable assist, and was planning on tearing the pack down and rebuilding it at some point.
One other thing, if I read the settlement right, you can get 2 $500 rebate vouchers towards the purchase of a new Honda which are transferable, IE you could sell them (they can only be transferred once), so I need to look into that too.

So, Formula, going to small claims court for your $10k?
EDIT: I wonder if there's going to be a rush on certain years of these cars now... you might be able to sell it to an "enterprising" small claims court type of person for, say $5k more than it's normal value.

Did you see the Yahoo story where a former lawyer in CA. won her suit
against Honda because it was claimed that her 2006 Civic Hybred.
WOULD!!! get 50mpg, and she never did??
She is to receive nearly 10,000.$$$$$
I was shocked that she could win.
No offense to you that live in CA., but we all know your cars are the most smog muzzled, and in full honesty; most regular CA civilians drive in a stand on it method nearly always.
Stop signs, and lights are commonly left w near to the floor "gassing it up
style"!!!
Several years ago, I tried to follow my Uncle down some residential streets.
I was in a high powered car, he in a plain average sedan, and he nearly lost me!
Former CA residents who move to the Portland-Vancouver area usually
are shocked to see how laid back, polite ( only in comparison), and green
conscience the mainstream actually is around here.
So; in no way am I surprised that she couldn't achieve 50mpg. !!!
Must have been another liberal judge! I actually feel bad for Honda on this!!!
It just smells bad!

Well, no, probably not. I really don't have the ambition to do something like that. I wish there was a better alternative, because the settlement is a joke. To me, the issue is not the MPG estimates but battery longevity. My car does get great mileage. I can actually exceed the EPA estimates by a greater percentage with this car than I could with my previous car. But now I have to figure out what to do for my ailing battery.

Well, I'm about to put my battery back in the car and try it out. I didn't find any "bad" subpacks after analyzing it (worst I found was a significant imbalance, and the weakest stick was 75% of nominal capacity). I still think if you do a more thorough (36 hour) rebalancing grid charge, you might find it will come back online. Though if it does work, you'll need to keep re-balancing it periodically to keep it working.
