So shouldn't the EPA make an updated rating? I guess they only do that for new cars.

Hmm. This is all news to me. Perhaps the 50 mpg figure was cited in a commercial? That's my best guess.
Imagine if Honda's defense attorney requested a trial run to prove that the car is capable of 50 mpg, and then if the judge begrudgingly granted his request...and he beat 50!
Ah, that's sounds more like a movie ending.

50 mpg is the combined rating prior to the 2008 EPA testing changes.

how convienent for you that you left out the part about FEDERAL LAW
Honda is not 'claiming' (check the definition)
Honda is STATING the required information required by the EPA.
The difference is....you would be intentionally decieving the buyer.
Honda is not.

Remember when Top Gear ran the Prius against the M3, and the M3 got better mileage?
If a Prius can be made to get less than 20 mpg, then any car on earth could easily get below 50 mpg!
But, there ya' go. No need for brains, just ask the judge!

I just skimmed this whole thread again, wasn't/isn't the issue that Honda recalled/asked owner to bring their car back to resolve a issue (reprogram cpu or what ever) that seemed to reduce useage of the battery to avoid battery failure while under warnatty at the expense of MPG. My older brother (so fairly reliable source) has a Accord hybrid (3.0 v6 why?) and lost MPG after a reprogramming?. I know he asked to have it returned to pre reprogramming and they wouldn't/couldn't.
I can understand being irrated by having Honda "fix" my car only to lose 5-7 mpg like my brother claims, if they did it to cover their ass, hit them with the 10k each.

I agree that the reflash is more of an issue here, which is why I won't let Honda touch my car. There's an open recall on part of the airbag system but I don't know if I trust them to do it without screwing with the computer.

Ok, I've seen some stupid law suits, but this one takes the cake.
