Well then Santa Cruz will just have to make their own then. Something like a Tesla drivetrain (only 400hp) in a R. Q. Riley XR-3 or the Arcimoto SRK.
The backs of the cycle fenders and the body itself could have plasma actuators to manage the air flow.

Elio wants nothing more than to REQUIRE 3 wheelers to be crash tested, but under different rules. (heck they lobbied for it)
The whole point is to make the 3 wheeler market too expensive for others to compete in.
So whether the law puts Elio in business or out of business they win.
A great excuse either way, while also crapping on the parade of homebuilt and commercial 3 wheel options already in the market.
