The Motor vehicle Act section 25 ..
Notifications and orders

25.08 (1) Despite an inspection certificate being in force, the director or a peace officer may, on having reasonable and probable grounds to believe that a vehicle may not comply with the standards, notify the owner or operator of a vehicle to present it for inspection to a designated inspection facility within the period set out in the notification.

(2) The director or a peace officer may order the owner or operator of a vehicle, in respect of which no inspection certificate is in force, to surrender to either of them the vehicle licence or the number plates, or both, for that vehicle.

(3) The owner or operator must comply with a notification under subsection (1) and an order under subsection (2).

(4) After examining a vehicle presented to the designated inspection facility following a notification under subsection (1), an authorized person must revoke any unexpired certificate, issue an inspection report in the manner set out in section 25.13 and

(a) issue a new inspection certificate of approval under section 25.13 (2), or

(b) issue an interim inspection certificate under section 25.13 (3)

on being satisfied that the conditions for issuing those certificates have been met.

(5) A notification under subsection (1) may require the owner or operator to notify the director or peace officer of the result of the required inspection.

The way it reads I have no choice but to submit to the inspection or surrender the plates and the car maintains a HOLD.
I have read that you can not take this to court as the judges will not hear it, the police have the right to impose this to anyone if they feel somethings in question.
The other thing I read in the act is that the police can basically keep imposing a new inspection any time they please.
Bottom line they will always win we lose do to the fact we can't even take it to court.

As for the $109 fine ..
General maintenance Act

4.04 (1) Lighting devices required by this Division must be maintained in good working order.

(2) Lamps and reflectors required by this Division

(a) must be securely mounted on the vehicle,

(b) must not have any cracked, broken, missing or incorrectly installed lenses, and a lamp must not have bent or broken rims that allow water to enter the lamp, and

(c) must not be shielded, covered or obscured by any part of the vehicle or load or by dirt or other material.

[en. B.C. Reg. 476/98, s. 2.]

The act reads as it reads I cannot disagree even if its subject to interpretation.

I don't necessarily think the cop is intentionally harassing so much as enforcing the traffic code. If the code sucks, it needs to be changed; the officer is just doing his job.

I'd be upset too, and I think it's ridiculous, but why does society allow our freedoms to be stripped away? We deserve the treatment we get.

The RCMP almost hired me years ago...that tells you all you need to know about their standards! If you need help getting your VX inspected let me know. And if you need pieces like tail lights or whatever you can rob them off my '93 VX if you want to drive to Richmond where it's sitting. We only had the VX for 2 years in Canada, we gotta look out for our VX brethren

"Just doing his job" is never an excuse. My mother-in-law told me about "Universal Soldier" by Donovan and I wanted to ask if she was trying to start a fight. The one time that I allowed my ex to drive with me in the car she laughed at me when I told her to come to complete stops and stay in her lane. She could have been cited for either. If that officer saw her again, he could follow her until she broke the law again, and unless she started driving legally, she would accumulate so many tickets that she could not legally drive, and then probably be caught for driving on a suspended license.

My ex is not a safe driver. I have a dent in Bacon to prove that. Meanwhile, I am paranoid because the police harassed me back in August, and I still have not been able to resolve that.

Does that RCMP stop every single speeder and everyone else that he sees violating any law? Seriously, how many speeders could an officer cite in one day? How long would it take him to find one after leaving the station? I have had dozens and dozens of people insist that it is more dangerous to drive the speed limit than speed [because everyone speeds], but why are the law-abiding citizens the dangerous ones?

WD40 broke the law. I am not going to try to justify it. I do not know about Canada, but short of becoming President of the United States and issuing presidential mandates, I doubt that it is very easy for one person to change the law.

How difficult can it be to become President? Well, pretty difficult for WD40! He would need to change the law before becoming President, but aside from that, Carter did it!

Go ahead! Get in a raging debate and get me in trouble over Carter!

I do not know anything about Carter...

The citizens of society have no say in the matter, but to speak up against it, as the freedoms are taken by force. It is bass ackwards thinking to blame the victims for the crimes of the tyrants, and a part of the reason this continues to happen.

I have 30 days from Feb 28 2015 to get the car passed inspection and repaired or off the road.
The car will be tested against the list available here

Honestly I doubt 80% of the crap on the roads today would pass.
The following is where I think it will fail..
1)throw out bearing (horrible sound from the transmission at idle with clutch out, in is quiet)
2)rear brakes need replacement (I have new drums and shoes)
3)adjust parking brake
4)timing belt and water pump way overdue and risky (I have the parts)
5)third brake light bulb needs to be replaced (have the bulb)
6)remove kill switch
7)repair disabled DRL
8)replace windshield (many chips and a few cracks)
9)engine oil leak (either valve cover or egr at side of block)
10)rear struts mount are lose and knock (I got used springs and struts to lower, the top strut nuts are stripped and can not be adjusted)
11)headlights need adjustment
12)clutch leaks fluid below the pedal (minor leak)
The car is totally drivable and safe but needs work any used car i have ever bought has been in worse condition.
I have been unemployed for the last 10 years (due to depression/anxiety issues)
My wife has been unemployed for almost 1.5 years but is going to university to become a social worker.
Money is very tight and its hard to get motivated with my issues, the only hobby I have is my car.
I know its a sob story .. but its my story.
I appreciate the the comments.

Cops work with a high level of autonomy. They make the decisions as to when, where, and why they write tickets. He didn't pull this man over and was then forced to give him a citation. In this instance he did it because he wanted to. We aren't talking about some kid out there trying to be Fast and Furious. We are talking about an adult driving his car for maximum fuel economy, what's the harm in that.
