It depends, it needs a certificate to be legal or I would need to get it certified.
However in that case I would also change the gearing as the bike revs roughly 10k rpm at the topspeed I archived without fairings, wich isn't good for fuel economy nor do I think it is good for reliability to rev that high for extended periods of time.
With fairings it would probably rev all the way into the limiter rather quickly.

Maybe the average policeman does not count sprocket teeth very often. If one did, maybe a jury would acquit you of any wrong-doing, and improve the law in the process. In Canada, mo-peds are supposed to be speed-limited, but in practice, anything goes as long as one is pedaling visibly.

I've mentioned it elsewhere, but I consider the CRF300L to be about the minimum for a bike. It's only $1,000 more than the 125, but that gives it a 90 MPH top speed so it can be driven on the highway. It gets 75 MPG.

Talking Kawasaki Ninja 125

I grew up in suburbs of philadelphia and my dad owned a Kawasaki Ninja 125 which was also the first bike drove and still do!
I personally prefer bike riding on the roads rather than the mundane and traffic prone car driving.

Are you sure you don't have a Ninja 250? Kawasaki didn't make a Ninja 125 until 2018 and it is not a US model. They did have a 150 Ninja but is was a 2-stroke single and also not a US model.

If you really have a Ninja 125 I would love to hear some more about it and see some pictures.

1972 Honda 125 Enduro

I rode one of these from '72 -to- 80.'
I played around with gearing, stanchion clip-ons, and fairings, but could never really exceed 40-mpg on the highway. My brother's H-D Electroglide, 1,200 cc V-twin cold routinely return 55-mpg, 'loafing.'
The Honda 250 Enduro single might have been a better choice. With a little 'reserve' power, it could potentially accelerate around or out of an emergency situation, whereas the 125 would be limited solely to braking.
For safety, I feel that a 125 is inadequate. Off-road, okay.
Today I'd choose electric.

How the heck did he get 55mpg on a 'glide? Bets I ever got was 30 with an actual streamlined vetter style windshield.
