What he's being investigated for is not alleged lying to cost stockholders billions.
What he's being investigated for is alleged lying to cost stock traders - possibly stock manipulators, billions. Stock traders and hypothetical manipulators who DIDN'T own any stock, BORROWED and SOLD a bunch in the expectation that it would drop, some of whom apparently hired, through cutouts, a bunch of trolls to talk the stock down.
So when he said (unfortunately for him, without cutouts) that they might be going private and the stock shot up, the people who sold the borrowed stock were stuck having to buy some back at a HIGHER price than they sold it for (which is what you risk if you sell a stock short), but the people who actually owned it were just fine.
So the shorts closed out some short positions and took a big loss. Then, since Musk said that in a way that COULD be traced to him, they were able to sue him for the losses and complain to the SEC, getting it to start an investigation. THEN the stock DID start to tank, and the people who owned it DID take a loss.

I'm listening to the Rogan podcast now (intermittently since it's so long). Elon is a very poor speaker and conveyor of ideas. It seems he has a hard way of articulating abstract ideas, and doesn't spend the time to explain them. He should take some speaking lessons for no other reason than to become more influential. I'm about an hour in, and he seems to barely be loosening up. I tend to be similar in that I'm socially awkward initially, and find a groove after about an hour. Part my difficulty is in letting go of whatever I'm thinking about or stressing over and fully engage in other topics, especially when they seem much less interesting than whatever I was thinking about.
When guys talk about sports, my eyes mostly glaze over. I enjoy watching a game here and there, especially with people very passionate and knowledgeable about the strategy, but I can't see myself investing much time into something that doesn't matter, and which changes every season.

supercharger network
Should Tesla get into trouble, they could sell license to supercharger network access to other EV makers.
I think that supercharger network is actually their biggest advantage in the EV market. If Musk is ready to sell the electricity to every car that stops by, Tesla will become largest network of charging stations, strategically placed around the U.S.

Musk has a contract with the air force to launch secret payloads in to space.
The air force is now forced to reevaluate the contract.

Musk is a terrible speaker, and that was a fairly boring interview. The problem is Rogan is a little on the dumb side (ignorant more like it), and Musk doesn't take the time to articulate ideas to common folk like Joe.
EDIT: Came out wrong. I like Rogan interviews since he doesn't have an agenda and is pretty good at prompting the guest to talk about something interesting.
Problem is that Rogan doesn't ask smart science/physics questions because that isn't his strength. Musk has long periods of silence before responding to a prompt, and delivers 1-word responses rather than elaborating.
I'm glad I listened, but it was among the more boring shows I've heard.

I thought it was fascinating. Like watching a left brain and a right brain talking to each other.
They ranged over Artificial Intelligence, simulations, flying cars vs tunnels. ....and electromagnetic bumper cars!
